These conditions of sale are concluded on the one hand by the company Waldos Legend, SAS with a share capital of 1000 euros whose head office is located in Anglet (64600), at 9 rue de l'Industrie, registered in the Trade and Companies Register of Bayonne under the number below 919803577 called "Waldos Legend" and managing the site www.cbdwaldoslegend.com and, on the other hand, by any natural or legal person wishing to make a purchase via the website www.cbdwaldoslegend.com hereinafter referred to as "the buyer".

Article 1. Purpose

These terms of sale aim to define the contractual relations between Waldos Legend and the buyer and the conditions applicable to any purchase made through the website www.cbdwaldoslegend.com. The acquisition of a product through this site implies unreserved acceptance by the buyer of these terms of sale, which the buyer acknowledges having read prior to his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site www.cbdwaldoslegend.com is not directly related to his professional activity and is limited to strictly personal use and on the other hand to have full legal capacity, allowing him to commit to these general terms of sale.

Article 2. Products

Article 3. Rates

Article 4. Order and payment terms

Before any order, the buyer must create an account on the site https://www.cbdwaldoslegend.com. The account creation section is accessible directly from the side menu bar. At each visit, the buyer, if he wishes to order or consult his account (order status, profile, etc.), must identify himself using this information. The Waldos Legend company offers the buyer to order and pay for his products in several stages, with 1 payment option to choose from:

Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. The next step asks him to check all the information, read and accept these general terms and conditions of sale by checking the corresponding box, then invites him to validate his order by clicking on the "Confirm my order" button.

Finally, the buyer is redirected to the secure Viva Wallet interface to securely enter their personal credit card details. If the payment is accepted, the order is registered and the contract is definitively formed. The credit card payment is irrevocable.

In the event of fraudulent use of the card, the buyer may demand cancellation of the card payment, the amounts paid will then be re-credited or refunded. The liability of the holder of a bank card is not incurred if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of his card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must contest, in writing, the direct debit with his bank, within 70 days following the transaction, or even 120 days if the contract binding him to it provides for it. The amounts withdrawn are reimbursed by the bank within a maximum of one month after receipt of the written dispute filed by the cardholder. No costs of restitution of the sums may be charged to the cardholder.

Confirmation of an order implies acceptance of these conditions of sale, recognition of having full knowledge of them and the waiver of the right to rely on one's own conditions of purchase. If the buyer has an email address and has provided it on their order form, Waldos Legend will send them an email confirming that their order has been recorded.

Article 5. Reservation of ownership

Waldos Legend retains full ownership of the products sold until full payment of the price, including principal, costs and taxes.

Article 6. Withdrawal

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, with the exception of return costs.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area. Orders are made by La Poste via COLISSIMO, a delivery service with tracking, delivery without signature and Mondial Relay via its delivery service to relay points. Delivery times are given for information purposes only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.

Waldos Legend may provide the buyer with the tracking number of their package by email. The buyer is delivered to their home by their postman. In the event of the buyer's absence, they will receive a delivery notice from their postman, which allows them to collect the products ordered from the nearest post office, during a period indicated by the postal services. The risks associated with transport are the responsibility of the purchaser from the moment the items leave the premises of Waldos Legend. The buyer is required to check in the presence of the post office employee or delivery person, the condition of the packaging of the goods and their contents upon delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

Article 8. Warranty

All products supplied by Waldos Legend benefit from the legal guarantee provided for in articles 1641 et seq. of the Civil Code. In the event of non-conformity of a product sold, it may be returned to Waldos Legend, which will take it back, exchange it or refund it. All complaints, requests for exchange or refund must be made by post to the following address: Waldos Legend, 9 rue de l'Industrie, 64600 Anglet, within thirty days of delivery.

Article 9. Liability

Waldos Legend, in the distance selling process, is only bound by an obligation of means. Its liability cannot be incurred for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.
